Almost every driver has been pulled over by the police for a traffic offense that may seem to be insignificant. However, even minor traffic offenses have consequences. For example, the New Jersey Point Schedule assesses points based on the type of offense involved. Those points affect your insurance rates and ability to drive if you accumulate too many.
If you have been charged with a traffic offense, you should seek the assistance of the experienced criminal defense attorneys at Bhatt Law Group. We have decades of combined experience in defending people against traffic charges. Call us at (201) 798-8000 right away so we can help protect your rights and driving record.
The New Jersey Point System
The New Jersey point system assigns a point value to most traffic offenses. Point values are assigned to offenses based on severity. For example, speeding at 10 mph over the speed limit is a two-point infraction, while speeding at 35 mph over the speed limit is a five-point infraction. Similarly, reckless driving is a five-point infraction and careless driving is a two-point infraction.
Under the point system, there are consequences to receiving points:
- When you have accumulated six points, the Motor Vehicle Commission (MVC) will notify you in writing of the number of points assessed and explain the point system. The MVC will also impose surcharges for three years.
- Once 12 or more points are accumulated, the MVC will classify you as a “persistent violator” and schedule the suspension of your driving privileges for six months.
- Once you are classified as a “persistent violator” and successfully restore your driving privileges, the MVC will place you on a period of probation for one year. If you receive a ticket and are found to be guilty of a violation during this period of probation, the MVC will schedule the suspension of your privileges.
Point Schedule for Common Violations
The point system assesses between two to eight points for some of the most common traffic offenses, including:
- Failure to yield to a pedestrian in a crosswalk: 2 points
- Failure to observe traffic signals: 2 points
- Speeding between 1 to 14 mph over the speed limit: 2 points
- Speeding between 15-29 mph over the speed limit: 4 points
- Speeding 30 mph or more over the speed limit: 5 points
- Reckless driving: 5 points
- Careless driving: 2 points
- Improper left or right turn: 3 points
- Improper U-turn: 3 points
- Failure to observe stop or yield signs: 2 points
- Racing on a highway: 5 points
- Leaving the scene of an accident involving personal injuries: 8 points
- Leaving the scene of an accident involving property damage: 2 points
Reduction of Points
Points accumulated by traffic offenses can be reduced. Over time, the MVC will reduce the number of accumulated points as long as you have not received a traffic ticket and been found guilty of a violation for 12 consecutive months.
Another way to reduce points is to take an MVC approved defensive driving course. If you successfully complete the driving course, the MVC will give you a two-point reduction once every five years.
