Not Guilty Verdict in Carteret Man’s DUI Case
Published in Criminal DefenseLike the rest of the country, the state of New Jersey takes driving under the influence (DUI) seriously, where even a first offense involves some very unforgiving penalties like the loss of your license for up to 12 months, hefty fines and surcharges to the Department of Motor Vehicle, mandatory classes, and even possible jail time. This was the reality a man from Carteret, NJ faced when police approached him when he was seen drinking alcohol in a parked car. Despite the fact that he was not actually driving, he was charged with his first DUI offense as well as an open container violation. The man knew that if he had any chance of avoiding these grim consequences, he’d need to consult with a veteran and DUI attorney with a lot of experience in DUI cases.
He consulted with the Bhatt Law Group who reviewed his particular situation. The attorneys with the Bhatt Law Group saw the potential to help their client and tenaciously argued in court that the charge could not be supported since the car was parked and there was doubt regarding his intention to operate the car. In the end, the judge agreed with this argument and found the man not guilty of the DUI. After paying a nominal fine for the open container violation, the man was relieved to move on from this unfortunate incident without a conviction.
